Terms of Service
1. Agreement
These Terms are a contract between you and SideGiggss (“SideGiggss”, “we”) for use of sidegiggs.app, the SideGiggss marketplace, ShiftAI and the mobile web app (the “Service”). By creating an account you accept them. If you use the Service for a facility, you confirm you are authorized to bind that facility.
2. What SideGiggss does
SideGiggss is a technology platform. Facilities post open shifts; SideGiggss ranks eligible clinicians, delivers offers, records confirmations and hours, and processes invoices and payouts through Stripe. SideGiggss does not itself provide healthcare services and is not a party to the clinical work performed at a facility.
3. Accounts
- Provide accurate information and keep it current, including credentials and contact details.
- Keep your password confidential. You are responsible for activity on your account.
- One account per person. Facilities may invite multiple users with different roles.
- We may suspend accounts that provide false information, misuse the Service or fall behind on payment.
4. Clinician obligations
- Hold and maintain a current, unencumbered license for the profession and state shown on your profile, and upload renewals before expiry.
- Accept only shifts you are qualified for and able to attend. A confirmed shift is a commitment; cancellations inside 24 hours may affect your rating and future offers.
- Submit accurate hours. Facilities review and may adjust hours before approval; disputes are raised through the app within 7 days.
- Follow the facility’s policies while on site and protect patient privacy at all times.
5. Facility obligations
- Post accurate shift details: unit, date, hours, pay rate and required credentials.
- Confirm clinicians only after reviewing their credential status; the facility remains responsible for its own credentialing and compliance requirements.
- Review and approve submitted hours within 3 business days. Hours not disputed within that period may be auto-approved.
- Pay invoices by their due date. Late invoices may pause new postings.
- Do not enter protected health information into the Service. See the Compliance page.
6. Pricing and payment
- Facilities set the hourly rate paid to the clinician for each shift. SideGiggss adds a platform fee, shown as a percentage in the facility’s settings and on each invoice.
- No charge is made until hours are approved. Approved hours are invoiced on the facility’s billing cycle and charged to the payment method on file or paid by ACH within the stated terms.
- Clinician payouts are made through Stripe Connect to the bank account the clinician links. Payout timing follows Stripe’s schedule after facility approval.
- Rates, fees and payout terms in effect during the pilot are provisional and may be revised with 30 days’ notice.
7. Worker classification
Unless a facility’s written agreement with SideGiggss states otherwise, clinicians working marketplace shifts are engaged as independent contractors and receive IRS Form 1099 where applicable. Facility employees working their own facility’s shifts remain that facility’s employees. This section will be finalized with counsel before the first paid shift.
8. Acceptable use
Do not misuse the Service: no scraping, no attempts to bypass security, no harassment, no posting of false shifts or credentials, and no use of the Service to circumvent it (for example, arranging shifts off-platform to avoid fees).
9. Intellectual property
SideGiggss owns the Service and its content. You keep ownership of data you upload and grant us a license to process it to provide the Service. Aggregated, de-identified statistics may be used to improve the Service.
10. Disclaimers and liability
The Service is provided “as is”. We do not guarantee that a shift will be filled or that a clinician will be offered work. To the extent permitted by law, SideGiggss’ total liability for any claim arising from the Service is limited to the fees paid to SideGiggss for the shift giving rise to the claim. SideGiggss is not liable for the clinical acts or omissions of clinicians or facilities.
11. Termination
You may close your account at any time. Outstanding invoices and payouts survive termination. We may terminate for breach with notice, or immediately for safety or legal reasons.
12. Governing law and disputes
These Terms are governed by the laws of the State of Florida. Disputes are resolved first by good-faith negotiation, then by binding arbitration in Hillsborough County, Florida, except that either party may seek injunctive relief in court.
13. Changes
We may update these Terms. Material changes are announced by email at least 14 days in advance; continued use after the effective date is acceptance.
